President and Prime Minister still at odds over Supreme Court President

The State Judicial Council will issue a new public tender for the election of a Supreme Court president on Wednesday. Current Supreme Court president Đuro Sessa has issued a statement saying that, in accordance with Rules of Procedure, he will appoint a vice-president next month, who will serve as Supreme Court President until a new one is elected. As for the Croatian President Zoran Milanović and Prime Minister Andrej Plenković, they still have completely different views. 

“A public tender is an anti-constitution category, in fact very damaging and unintelligent; because now it has been shown they must be repeated. Second, that disables me from previously agreeing about a certain candidate with the main participants, that is the president of the biggest party, the Croatian Democratic Union and certain other people in parliament. In this manner the only thing I can do is choose someone after the public tender. It's just as bad if I suggest that someone replies to the tender and then I propose them,” said President Zoran Milanović.

President Milanović added that he is referring to those that change laws and adopt laws that are explicitly against the constitution.

"This was done in order to limit the president, not me. The law was adopted at the time of President Kolinda Grabar-Kitarović and the person that will now patch that position is a person that has no legitimacy," said the President.

“I don't know where blabbing about whether or not this will last until the end of the mandate came from. I don't know who even brought it up. What he does and says is not normal, and that is how I see his statements that have no shame, are wrong and bad. Just as he is no reformer of the judiciary, he should not underestimate people that will respond to the third public tender. When things will be done according to procedure, we have numerous lawyers, be they judges or something else, that can fulfill the task,” said Prime Minister Andrej Plenković when commenting the president’s statement.

Plenković added that the lesson learned is that the President has broken the law, noting that he does not respect the Constitutional Court and imposed a candidate outside the legal procedure.

"If the best lawyer in the world showed up, and I'm not talking about Professor Đurđević at all, if it was anyone, they would not be chosen. First we'll see if the new procedure that he imposed is legal, that is the first test, and the second test is that we will see who the candidate is," said Plenković.
